Terms and Conditions of Participation in Events

TERMS AND CONDITIONS OF PARTICIPATION IN EVENTS:

1. GENERAL TERMS&CONDITIONS

These terms and conditions ("Terms and Conditions") contain the general terms and conditions of participation in events organized by Tinto del Arte by Agata Rafalska-Hardie ("Organiser") and constitute part of the agreement concluded between the Organiser and the Event Participant.

The purpose of these Terms and Conditions is to ensure order and safety for individuals who will be present at the Event Area during its duration.

These Terms and Conditions are addressed to all individuals who will be present at the Event Area during the Event. Each individual present at the Event Area during the Event is obliged to:

a) Strictly comply with the provisions of the Terms and Conditions, fire safety regulations, provisions of generally applicable law, and public order, as well as to comply with the instructions and orders of the Organiser and its employees.
b) Behave in a manner that does not endanger the safety of other individuals.

It is assumed that every ticket holder, before entering the Event Area, has acquainted themselves with the provisions of these Terms and Conditions and undertakes to strictly adhere to them.

The number of places at the Event is limited.

2. DEFINITIONS:

a) Organiser – Agata Rafalska-Hardie
b) Participant – an individual attending the event, possessing full legal capacity, and aged at least 18 years old on the day of the Event.
c) Event - a ticketed event organised by the Organiser at selected venues in Spain.
d) Event Area - the designated location where the Organiser's event takes place.
e) Ticket - a confirmation of booking for the Event received via email after registration and payment, containing the assigned reservation number.
f) Force Majeure - an external, sudden, unpredictable event beyond the Organiser's control, rendering the fulfilment of obligations impossible or impractical.

3. EVENT SAFETY

The Organiser reserves the right to refuse entry to the Event Area to the following individuals:

a) Persons without a Ticket to the Event
b) Ticket holders who have not reached the age of 18 on the day of the Event;
c) Ticket holders in cases justified by safety reasons, including epidemic safety regulations;
d) Ticket holders found to be in possession of weapons, explosives, pyrotechnic articles, flammable materials, or other dangerous items that may pose a threat to human life and health;
e) Ticket holders under the influence of alcohol;
f) Ticket holders behaving aggressively, provocatively, or in any other way posing a threat to the safety or order of the Event.
g) Ticket holders under the influence of narcotics or psychotropic substances;

Smoking is strictly prohibited within the event premises. This includes all indoor and outdoor areas of the event venue. Attendees are expected to comply with this policy for the duration of the event.

In cases justified by safety reasons, the Organiser may demand that the ticket holder immediately leave the Event Area and take appropriate steps to ensure that such an order is complied with. This applies in particular to situations where such individuals disrupt public order, behave aggressively, or act contrary to these Regulations.

4. DUTIES AND LIABILITY OF THE ORGANISER

The Organiser's responsibilities include ensuring that valid Entry Ticket holders are granted access to the Event Area corresponding to their Ticket for participation in the Event, as well as providing the necessary organisational support for the Event and ensuring its smooth execution.

The Organiser shall not be held liable for:

a) any loss or damage to Participants' property left on the Event Area (the Organiser does not offer storage facilities);
b) accidents and incidents resulting from the violation of the provisions outlined in these Regulations;
c) any consequences arising from Force Majeure events.

5. CANCELLATION OF THE EVENT, CHANGE OF DATE, VENUE, OR EVENT PROGRAM

The organiser reserves the right to cancel the event without prior notice, for reasons for which the organiser is not liable. In such a case, ticket holders are entitled to rights provided by law.

The organiser has the right to change the date, venue, or program of the event for valid reasons, such as the announcement of national mourning, adverse weather conditions preventing the event from taking place (applies to outdoor events), illness, indisposition, or other objective reasons beyond the organiser's responsibility preventing the event from taking place on the planned date, and cases where the change is necessary to ensure the safety, health, or life of people or property, or to ensure an uninterrupted and comfortable course of the event for participants.

In such circumstance purchased tickets remain valid.
If the new date or venue of the event is not suitable for the ticket holder (except for a change of venue within the same locality), the organiser will offer them a voucher equal to the price of the purchased ticket to be used in the online store available at https://tintodelarte.es. In case of refusal of this solution, the organiser will refund the ticket holder for the unused ticket. The ticket holder is obligated to inform the organiser of their decision regarding the acceptance of the voucher in place of the unused ticket or the request for a refund to the email address: info@tintodelarte.es within 7 days from the date of receiving information about the change of the event date or venue. Failure to express consent to accept the voucher within the aforementioned period will be treated as a request for a refund of the ticket.

In case of a request for a refund or failure to express consent to accept the voucher within the 7-day period, the organiser shall refund, without undue delay, no later than within 14 days from the date of receiving the request, the amount equivalent to the value of the unused ticket. The refunds are made using the same payment methods as those used in the original transaction, unless the ticket holder has agreed to another solution that does not incur any costs for them.

6. RIGHTS AND OBLIGATIONS OF EVENT PARTICIPANTS

Included in the Ticket Price, the Organiser Ensures:
a) Unlimited consumption of wine (white and red) during the Event; for non-drinkers, the Organiser ensures access to water;
b) Snacks;
c) A complete painting kit available during the Event (including an easel, canvas, acrylic paints, brushes, and an apron);
d) Professional support from the Artist Painter;
e) The right to take home a painting created during the Event, with dimensions of 40×50 cm.

Purchased tickets are non-refundable.
Ticket exchange, understood as changing a reservation for another date, including changing participation in an event taking place in another location where events are organized, is possible no later than 72 hours before the planned event. After this deadline, changes will not be possible.
For changing a reservation, the Organiser charges an additional fee of €10 per person, which must be paid before the deadline mentioned above.

The Organiser reserves the right to cancel the Event without prior notice. The Organiser will not be obligated to provide any compensation or indemnity to the Ticket holder other than the ticket price refund.
The Organiser reserves the right to introduce changes to the course of the Event for justified reasons, such as Force Majeure, the need to apply specific epidemic safety measures, etc., as well as the right to change the Event program without prior consultation and compensation.

7. PHOTOGRAPHY AND MEDIA RELEASE

By participating in this event, you consent to the capture and use of your image in photographs and/or videos that may be taken during the event. You agree that these images may be published on but not limited to social media platforms, websites, and other marketing materials, without further notification or compensation. If you have concerns or do not wish your image to be used, please let Agata Rafalska-Hardie know upon arrival.

8. DATA PROTECTION – CONSENT TO PROCESS PERSONAL DATA, GDPR INFORMATION CLAUSE

a) The Organiser is responsible for the collection and processing of personal data of Participants in connection with their attendance at the Event.

b) Personal data collected by the Organiser is necessary for the purpose of facilitating Participants' involvement in the Event and for any other legitimate purposes outlined in the Privacy Policy available on the Organiser's website. By participating in the Event, Participants expressly consent to the Organiser processing their personal data, which may include their image, name, surname, email address, and phone number. Participants acknowledge and agree that their personal data may be processed for the purposes of event management, communication, and promotional activities related to the Event. The Organiser ensures that all personal data is processed in compliance with applicable data protection laws, including the General Data Protection Regulation (GDPR) and Spanish data protection regulations. Participants have the right to access, correct, or delete their personal data held by the Organiser, as well as to withdraw their consent for processing at any time. The Event may be broadcast live on social media.
